These terms apply when you use this website ("EligibilityGuide", "we", "us"). By using the site, or by clicking a button that says you agree, you accept them. If you don't agree, please don't use the site. You must be at least 18 to use it.
What this site is — and isn't
EligibilityGuide is an advertising and lead-generation service. We help you see what benefits you may qualify for and, with your consent, connect you with service partners who help people pursue claims. Service partners pay us a fee for access to consumers who use this site. This website is an advertisement.
We are not a law firm, a government agency, or a benefits provider. EligibilityGuide is a private company, not a government agency. It is not affiliated with or endorsed by the Social Security Administration, the U.S. Department of Veterans Affairs, or any other government agency. We give no legal, medical, or financial advice. Using this site does not create an attorney-client, advocate-client, or any other professional relationship with us, and it does not by itself create one with any service partner. We are not a HIPAA covered entity, and information you submit here is not "protected health information" under HIPAA.
No guarantees
Our screening questions are intake questions, not eligibility determinations. We do not and cannot guarantee that you qualify for any benefit, that any claim will be approved, that any amount will be paid, or that a partner will take your matter. Eligibility is decided only by the agencies and courts that run each program. Free help also exists — you can always contact the SSA, the VA, or an accredited Veterans Service Organization directly, at no cost.
Service partners are independent
Partners named on our Partners page are independent businesses. We don't control them and don't endorse one over another. Any agreement you make with a partner is between you and that partner, and any dispute with a partner is between you and that partner — you release us from claims arising out of their services.
Using the site
Submit only true information, about yourself, with the right to share it. Don't misuse the site: no scraping, harvesting, automated bulk access, or use of the site's content to train automated systems; no interfering with the site's operation; no unlawful use. The site's content, design, and branding belong to us or our licensors; we grant you a limited, personal, non-commercial license to use the site as intended.
Disclaimers and limits
The site is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent the law allows, our total liability for any claim arising out of the site or these terms is limited to $100, and neither of us is liable to the other for indirect, incidental, special, consequential, or punitive damages. Any claim must be brought within one year of the events giving rise to it. Some states don't allow some of these limits; where a limit isn't allowed, it doesn't apply. You agree to indemnify us against claims arising from your misuse of the site or breach of these terms.
Disputes and arbitration
We hope never to need this section. If we have a dispute that we can't resolve informally, you and we agree to resolve it by binding individual arbitration before the American Arbitration Association under its Consumer Arbitration Rules, rather than in court — except that either of us may bring an individual claim in small-claims court.Class actions and class arbitrations are waived — disputes are resolved individually. You can opt out of this arbitration agreement by giving us written notice within 30 days of first accepting these terms; opting out does not affect any other part of these terms. We will publish the notice channel for opt-outs on this page before we begin accepting requests.
Changes
We may update these terms by posting a new version here with a new effective date; changes apply going forward. A change to the "Disputes and arbitration" section will not apply to a dispute that arose before the change was posted.
Miscellany
If part of these terms is held unenforceable, the rest still applies. These terms plus the Privacy Policy, theConsumer Health Data Privacy Policy, and the consent language on our form are the whole agreement about the site.
